Wedgwood,
established in 1996, is a specialist supplier of presentation
equipment including: plasma screens, computer and video projectors,
interactive whiteboards, LCD monitors and accessories.
Terms
and conditions
1.
Orders
1.1. We only sell goods in the UK
to businesses, corporations, educational establishments, medical
establishments, government bodies and registered charities.
1.2. We only deliver to registered company address.
1.3. Goods are NOT sold on a sale or return evaluation basis. Please
ensure you order carefully.
1.4. Please note we do NOT sell goods to consumers (private
individuals). We reserve the right to refuse an order without
any reason.
1.5. Please do not book installations of equipment before delivery
to give you chance to receive and fully test the equipment.
We will not be held responsible for any additional expenses you
may incur, for instance, late installations.
1.6. Please allow ample time for equipment to be delivered which is
required for time critical missions, such as exhibitions,
presentations, etc., as we will not be held responsible for any
additional expenses your may incur.
1.7. You can cancel your order at any time up to the time of despatch
without incurring a restocking fee of 25%. However, if you have
paid for your order by credit card, you will be charged the credit
card surcharges, which is 2% of the total amount of the order.
1.8. If you cancel your order after the goods have been
despatched to you, a restocking fee of 25% will be charged, in
addition to any credit card surcharges, which is an additional 2% of
the total amount of the order. The goods MUST be returned unopened in original, manufacturers
packaging, otherwise the goods will be deemed to be your property and
as such must be paid for.
1.9. Projector lamps,
bespoke brackets and special orders. We have to order most projector lamps
and other bespoke items on special
order with the manufacturers. Please ensure you order the
correct model carefully as the manufacturer and therefore ourselves,
cannot accept order cancellations or returned goods once ordered.
Once ordered, goods have to be paid for in full.
2. How to order and payment terms
2.1. We cannot accept telephone orders. Orders can be faxed to 01754
768036. Or call us on 01754 769967your requirements and
we will produce a full quotation first if required.
2.2. Flexible payment options include cheque, bank transfer,
Visa, MasterCard credit cards, UK Maestro and
Delta debit cards. We do not charge a credit card surcharge. We are unable to accept card payments on
personal cards. We only accept card payments on business cards.
2.3. 14 or 30 day credit accounts are available for government,
government funded schools, colleges and universities (not private
schools or academy), local councils, public sector, NHS government
funded
hospitals and clinics(not private clinics, doctors surgeries or
dentists). Credit application forms are available for blue chip companies, the first three
orders payable upfront on proforma invoice.

2.5. Purchase orders must include delivery address, invoice address,
goods, prices, delivery price, quotation number and credit card
surcharge if applicable. Purchase orders must be signed by the
authorizing person. Please note that we perform full identity
and credit checking due to the high value of the goods we supply.
2.6. Orders can only be accepted for delivery to your registered
trading address.
2.7. When ordering goods for installation or time-sensitive on-site
contracts, please ensure you order your goods well in advance in case
of unforeseen events that may delay delivery. We will not be liable
for any failure to effect delivery in any circumstances, foreseen or
otherwise.
2.8 Payment of goods on credit accounts. In default of payment and
where payment exceeds our normal credit terms, interested is charged
at a rate of 10% above Bank of England rate rate from the date
payment is due, together with all costs of recovery.
2.9 Property in all goods supplied does not pass to the buyer until
after full payment has been received and cleared.
3. Delivery and checking of goods
3.1. All goods will be subject to availability.
3.2. Once delivered goods cannot be exchanged or returned.
3.3. Delivery dates are given in good faith as supplied by the
manufacturers or their distributors. We will not be liable for any
failure to effect delivery of the whole or part of any order due to
any events, errors or any other circumstances. If delivery is delayed we will
notify you as soon as we are aware of the delay and you agree
to give us such an extension to effect delivery as is reasonable in
the circumstances, especially when goods are customized to your
requirements. For non-customized goods you can cancel the
order without penalty on both sides.
3.4.
Please do not book installations of equipment before delivery to
give you chance to receive and fully test the equipment.
We will not be held responsible for any additional expenses you
may incur, for instance, late installations.
3.5. Please allow ample time for equipment to be delivered which is
required for time critical missions, such as exhibitions,
presentations, etc., as we will not be held responsible for any
additional expenses your may incur.
3.6. Goods MUST be checked for physical damage before signing to
accept delivery from the courier. If the goods are damaged or broken,
please DO NOT sign for the goods. Contact Wedgwood AV Ltd immediately
by telephone 01754 769967. When signing for acceptance of your goods,
you are signing to accept ownership of your goods in perfect physical
condition. If you do not check the goods at time of signing, and the
goods have been broken in transit, you will forfeit your right to
reject the goods for physical damage and we cannot replace or take
back your goods. Similarly, if there are any shortages and you
have chosen not to check the delivery before signing and accepting
them from the courier, then you have waived your right to claim
against us where such damage or shortages were readily ascertainable
at the time of delivery by checking the goods. In any event,
we accept no liability for shortages, incorrect or damaged
deliveries unless you have NOT SIGNED for the goods and phoned us to
refuse delivery.
3.7 Once you have accepted your goods, please note you have 2 working
days to check that your product is working satisfactory. Should the
goods not work satisfactorily you must contact us to obtain a returns
number in order that arrangements can be made for collection and
inspection, providing the goods are undamaged, unused, and in their
original packing and you have not marked either the goods or their
packing in any way. If you fail to comply with these terms
you will be deemed to have accepted the goods.
3.8 The only exception to 3.7 is
the purchase of Panasonic Panaboards (copyboards) with installation.
The package must NOT be opened. The installer will do that. If you
do open the box it will invalidate the extended warranty that comes
with the install.
3.9 Goods returned in undamaged, unused condition and in their
original packing which has not been defaced in any way, will be
inspected by the manufacturer or their distributor and a replacement
or return of your goods will be made based on their decision.
3.10 After two working days, the manufacturers warranty comes into
effect. Please note goods are NOT sold on a sale or return basis.
3.11 Wedgwood AV Ltd will not be responsible for any labour
charges, rental charges, loss of profits, charges, expenses, any
other charges nor consequential loss or damage as a result of
delivery delays, incorrect goods or defective goods being delivered
to its customers.
4.
Quality of goods
4.1. We warrant that (subject to the other provisions in these
conditions) the goods will be of satisfactory quality.
4.2. As we are not the manufacturer of the goods, all warranties,
conditions and other terms implied by statute or common law (except as
to title) are, subject to above, expressly excluded. However, we will
endeavour to pass on to you the benefit of any warranty or guarantee
given by the manufacturer in respect of the goods.
4.3. Wedgwood are not liable for
'fair wear and tear' of manufacturers' products, and/or any defects
or problems whatsoever are not the responsibility of Wedgwood
AV Ltd nor any of its subsidiary companies. Any 'not fit for
purpose' complaints must be taken up with the manufacturer
concerned, and is not the responsibility of Wedgwood AV Ltd, nor any
of its subsidiary companies.
4.4. Where the goods incorporate software, title of the software is
subject to the manufacturers license. You agree to comply fully
with the terms of any software license that is supplied with the
goods. Failure to do so may lead to such software license being
revoked by the owner of the software. We cannot take liability
for any changes to software which may affect the operation of your
equipment.
5. Description of goods
5.1.
Description of goods on the website is given for the purpose of
providing information on manufacturers goods. Such goods are liable to
change in specification by the manufacturers without notice.
5.2. Although every care is given to providing accurate descriptions
and pricing on the website we cannot be held responsible for any
incompleteness, errors or omissions. E.& O.E
5.3. Product guides are produced by Wedgwood AV Ltd for the sole
purpose of providing general information on audio visual
equipment. No liability can be accepted for the completeness or
accuracy of these guides.
5.4. Wedgwood AV Ltd
(Wedgwood IT Group), produce product selection wizards for its
customers. The products displayed in these wizards are only from
products supplied by Wedgwood, and specifications displayed are
correct to the best of our knowledge. E. & O.E. The wizards
are provided to educate and help visitors and customers to find
products which may meet individual requirements. Any products
ordered from Wedgwood or its subsidiary companies, based on the
results of the wizards, are done so at the purchases own risk.
Manufacturers specification sheets are provided for almost all
products on our websites, and it is the customers responsibility to
check that the specifications meet their requirements. E. &

5.5. Wedgwood IT Group take no responsibility for any problems or
accidents resulting from installation or equipment. It is recommended
that a qualified electrician or other competent person should
always perform installation and measurements. You should allow
ample time for goods to be delivered before booking any
installations as we cannot be held responsible for late deliveries,
DOA (dead on arrival) products, or any other reason, that would
cause your installation to be delayed or cancelled.
5.6. RoHS is the acronym for Restriction of Hazardous Substances.
RoHS also known as Directive 2002/95/EC, originated in the European
Union and restricts the use of six hazardous materials found in
electrical and electronic products. All applicable products in the
EU market after 1 July 2006 must pass RoHS compliance.

6. Warranties
6.1. All goods are covered by manufacturers warranties as stated
on the manufacturers product description.
6.2.
Unless otherwise marked, all products are new and come with a 1
year manufacturers RTB limited warranty. Please note that although
warranties may be 1 year RTB, 2 year RTB, 3 year RTB, etc., all
manufacturer warranties are limited. This means that not all of the
components of a product are guaranteed for the warranty period, some
parts may be excluded from the warranty. Multimedia projector lamps
come with a manufacturer one month RTB warranty, either separately or with a
projector.
6.3. Any issues or complaints arising
from manufacturers products, associated with 'fair, wear and tear',
or 'not fit for purpose', is not the responsibility of Wedgwood AV
Ltd nor its subsidiary companies. Any such complaints arising from
manufacturers products must be dealt with by the purchaser with the
manufacturer or under the manufacturers warranty.
7.
Return of goods
7.1 We do NOT sell goods on a return or sale
basis. Any attempt to return goods to our business address will
be refused delivery.
7.2 Goods which are DOA (dead on arrival) must be reported to us
within two working days for replacement at our expense. After
this two day period, the manufacturers warranty comes into effect for
any faulty goods.
8. Title
8.1.
Risk of damage to or loss of goods shall pass to you on delivery and
any outstanding debt beyond the payment terms granted will be
recovered by legal procedure.
9. Assignment of goods
9.1. You may not assign, charge or transfer any of your rights or
obligations under any Contract without our prior written consent.
We may assign and/or sub-contract any Contract at any time on notice
to you.
10. Force majeure
10.1.
Wedgwood AV Ltd is not liable for delays in delivery or cancellation
of your order caused by circumstances beyond its reasonable control.
Examples are supplier transport, manufacturers production problems,
governmental action and natural disasters. If this lasts for more than
two months, then the contract may be terminated by either party
without compensation.
11. Contract
11.1. The Contract shall be governed by the laws of England
and the parties shall submit to the sole jurisdiction of the English
courts.
